Terms & Conditions

By browsing, using and visiting Kids e-Toys.com you agree and accept to be bound to these terms and conditions.  We recommend you read these carefully.

For the purpose of these Terms and Conditions, “we/us/our” and “the company” refers to Kids e-Toys Ltd and “you/your”, “member” and “client” refers to the customer whose name and details appear in the contract.

Disclosure of Personal Information
In general, we do not sell, rent or otherwise trade your personal information with third parties for compensation.  However, we may disclose and share your personal information with third parties under the following limited circumstances.

Personally identifiable consumer information is shared with credit card transaction processors to the extent necessary for the company to deliver payment processing services.
We utilize a third party to personalize and optimize our web pages, to track consumers’ interaction with our site, and to produce consumer surveys.
We will also provide your delivery addresses to our employees for delivery purposes. By providing such services, these companies, agents or contractors may have access to your personal information.  However, these companies are not permitted to use your personal information except for the purpose of providing the services we request of them.

Users
Please note that you must be 18 years or older to subscribe to the Kids e-Toys service.  However, individuals under the age 18 may use our service under the supervision of a parent or legal guardian.  We have no intention of collecting personal information from individuals under the age of 18.   

Membership
Applicants for membership are making an offer to join Kids e-Toys which may be accepted or rejected at the company’s discretion.  The offer is made via the Login page and all details added must be true, current and correct. 
Members must be aged 18 or over. 
Members must have a valid method of payment (Visa, or MasterCard).

Cancellation of Membership
You may cancel the membership any time after having met your contract period.  If you wish to cancel the membership before fulfilling the 3 or 6 or 12 months contract, the company reserves the right to charge a cancellation fee.  If you are cancelling 3 months contract, the cancellation fee is $25.  If you are cancelling 6 months contract, the cancellation fee is $35.  If you are cancelling 12 months contract, the cancellation fee is $50.  All items/toys must be returned to avoid any additional charges.  You may cancel your contract by contacting Kids e-Toys by phone or email.  Our contact information can be found on the Kids e-Toys website under the “Contact Us” link.  Upon cancellation, you are required to give two optional days to pick up any outstanding rental toys by Kids e-Toys staffs.  Failure to collect such rentals will result in your Payment Method being billed for the retail cost of such items.  We will send you a reminder email concerning unreturned toys prior to charging your Payment Method.   

Kids e-Toys Service & Delivery
Our service allows registered client to access the website and rent toys from Kids e-Toys in accordance with these Terms and Conditions.  Once payment of the monthly membership fee has been made and the relevant identification has been confirmed, the client can choose to rent toys from our toys selection in accordance with the terms of the appropriate membership plan chosen, and have them delivered to the client’s shipping address.   Kids e-Toys reserved the right to withdraw toys from our range at any time and without prior notice.

Delivery time for toys you have selected to rent may vary based upon, (a) your shipping address, (b) toys availability (c) when you place an order, and (d) other circumstances impacting delivery by our staffs.  We will use our reasonable endeavours to ensure that the toys reaches you within three (3) days of our order being placed, however, Kids e-Toys makes no grantees as to actual delivery time and time for delivery of the toys to you shall not be of the essence of your contract with us. 

The applicable monthly membership fee will be charged to your credit card on the date your membership is created and each month thereafter, on the calendar day corresponding to the commencement of your membership.  We will automatically invoice your Payment Method each month unless and until you cancel your membership.  In the event your membership began on a day not contained in a given month, we will invoice your Payment Method on the last day of such month.  There are no refunds or credits for partially used periods and all fees and charges are nonrefundable.  We may change the fees and charges in effect, or add new fees and charges from time to time, but we will notify you in advance about these changes by e-mail.  If there is a change in your credit card validity or expiration date, you may edit your Payment Method information by signing on to your Kids e-Toys account.  If your Payment Method reaches its expiration date, your continued use of the service constitutes your authorization for us to continue billing that Payment Method and you remain responsible for any uncollected amounts.

Kids e-Toys reserve the right to cancel an order at any time at our own discretion.  If this happens, the credit card will be refunded in full.  Kids e-Toys also reserve the right to cancel an order if they are unhappy with any identification provided.

If Kids e-Toys does not receive payment from your credit card provider, your details are incomplete or inaccurate or if your credit card expires or rejected, notwithstanding our right to terminate your membership, you agree to pay all amounts due upon demand.  Kids e-Toys reserves the right to take all steps necessary to collect amounts due from you, including but not limited to using third party collection agencies to collect such sums (together with the costs of us taking such action).  Kids e-Toys reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

Without prejudice to any of our other rights under these Terms of Use, we may modify the price, content, or nature of the Service at any time. If we modify any of the foregoing terms, you may terminate your membership. We may provide notice of any such changes by e-mail, notice to you upon log-in, or by publishing them on the Site.

Termination
You agree that we at our reasonable discretion may terminate or restrict of our service, without notice, for any or no reason whatsoever.  In order to subscribe to the Kid e-Toys service, you must be 18 years of age or older.  However, individual under the age of 18 may utilize the service but they must be supervised by a parent or legal guardian. 

Member Responsibilities
The members will ensure that children using our toys are properly supervised at all times by their parents or babysitters t o ensure that no child is injured while using our toys.  In no event will Kids e-Toys be held responsible for any damage, loss or injury caused by or arising out of the use of any toys supplies including consequential loss or damage suffered by the member.
It is the responsibility of the members to ensure that the toys are used appropriate – for example parents should be aware of choking hazards to small children from small parts, and should consider the age appropriateness when borrowing toys.

Facts about Toy Sanitizers
We believe that one good way to keep children healthy is to clean and sanitize the toys they play with.  Our toys are cleaned sanitized with 100% all Natural, Organic cleaning product that is approved by CEPA of Environment Canada and Health Canada.  If you would like to get more details regarding our cleaning products, please email us at contactus@kidsetoys.com.   

Returning Toys
It is your responsibility to return the toys in a reasonable good condition after their usage. The returning toys must be placed in the original box provided by us. The box must not be sealed when our staff comes to pick them up because it helps our staff to check the condition of the toys. 

Lost or Damaged Toys
Should the toys become damaged, lost or stolen, the member agrees to meet the costs incurred by such an occurrence.  The manufacturer cost of the toy will be charged on the member’s Payment Method. 

Linked Sites
We may provide, or third parties may provide, links to other Web Sites or resources that are beyond our control.  Please note that we are not responsible for the content that appears on those sites and we do not endorse these sites.  Kids e-Toys is not responsible for the content on the internet or web pages that are contained outside the site.  You should review each site’s privacy policy to determine their use of information.

Changes to Terms and Conditions and the Web Site
Kids e-Toys reserves the right to modify and change the site and the Terms and Conditions at our discretion and without notifying members.  Modification to the web site will be ongoing, to include our promotions, new toys being added and obsolete toys being removed, new features and other modifications as we see fit.  Kids e-Toys will correct and mistake or omissions as soon as they are discovered.  Members should check the Terms and Conditions regularly.
